Personal Injury
Many thousands of people suffer some form of personal
injury every year, for many of these the injury will be through their
own actions, however a great number of those injured will be so because
of the fault of a third party. In these cases the people injured will
generally be able to seek compensation for the injuries that they have
suffered and any expenses that they have faced as a direct result.
Personal injury ranges from minor whiplash from a road traffic accident
through to permanent disability caused by another’s negligence and
every possible event in between. If you have suffered pain or discomfort
as a result of an event where you were not directly responsible then you
will have the right to pursue a compensation claim against the responsible
party.
In order to make any resultant claim as strong as possible, there are
steps that you should take immediately after the incident, the first thing
that you should do is to write down all of the details of the circumstances
in which you suffered your personal injury. Try to do this as soon as
you can so as the facts are fresh in your memory, and include as much
detail as you can, don’t put it off thinking that you will be able
to remember everything okay anyway, you’ll be surprised at how easily
you can get events out of sequence or forget small details. Be sure to
include full details of the personal injury that you have suffered, seek
medical advice and ensure that the medical practitioner records the details
of your visit.
If possible, you should take possession of any evidence that will aid
your claim, such as the item that caused your injury. If you are unable
to take possession of any items, put their owners on notice that they
are evidence in a personal injury claim and that they must not destroy
or modify the items. Taking photographs of the scene and the objects involved
is also a good idea as it will show the situation in which the incident
took place clearly and cannot be disputed unlike a witness statement.
Personal injury can be costly to the injured party, not only will there
be medical bills to cover, but there is the potential loss of earnings
due to an inability to work as a result of the injuries sustained. In
extreme cases this inability to work may be permanent, and in addition
there could be a requirement for full-term care – all of this would
be hard enough to bear without the financial strain that these situation
would place on a individual or the family, compensation from the guilty
party for the personal injury could at least remove this worry.
Nobody ever wants to be on the receiving end of personal injury, but the
fact is that thousands are injured every year and the results can be as
painful financially as they are physically, which is why many seek compensation
for the pain that they have suffered as the result of someone else’s
actions.
